Oprah to Palin: I Can Pencil You In Later

Oprah has issued a statement to TMZ -- she won't put Sarah Palin on her show until after the election.

Here's the statement: "The item in today's Drudge Report is categorically untrue. There has been absolutely no discussion about having Sarah Palin on my show. At the beginning of this Presidential campaign when I decided that I was going to take my first public stance in support of a candidate, I made the decision not to use my show as a platform for any of the candidates. I agree that Sarah Palin would be a fantastic interview, and I would love to have her on after the campaign is over."

For the record, Barack Obama has been on "Oprah" twice -- in January, 2005 and again in October, 2006 -- before he announced his run for Prez.

Apparently Sandra Bullock's "Speed" residuals may have run dry, because her hubby is having trouble paying his bills.

Mr. Sandra Bullock is being sued by his former lawyer for $327,533 in unpaid fees. Jesse is the owner of West Coast Choppers -- which has a huge celeb clientele -- so he shouldn't be hurting for dough.

Calls to James were not returned.

Memba the actor who tried stabbing his GF 20 times (allegedly)? Well a judge today cut actor Shelley Malil a break.

Malil -- who appeared in "40 Year Old Virgin" -- has been held on $10 million bail after he was arrested for allegedly stabbing Kendra Beebe last month near San Diego. Today the judge reduced bail to $3 mil, with one string. Malil can't get out unless he goes into rehab. Malil's lawyer confessed to hizzoner that his client has a serious alcohol problem.

We're thinking he may have an anger management problem as well.

Legal papers have just been released in the Hulk/Linda Hogan divorce case, and poor Hulk is getting poorer by the month.

According to the documents, first obtained by the St. Petersburg Times, Hulk pulls in $56,708 a month. Problem is -- he's spending $104,451 a month, which means he's in the red each month by $47,443.

Don't feel too sorry for Hulk -- He puts his net worth at $32.4 mil.

As for Linda, she says she spends $7,258 on clothes, $7,502 in maid service, and, of course, $6,100 a month on vacations. Linda drops $2,464 on pool and lawn service (not including the pool boy) and $1,374 in pet expenses. She's currently pulling in $40,000 a month in support.

Man Charged in Murder of Ashton's Ex

Michael GargiuloSeven years after her murder, a suspect has finally been charged in the stabbing of Ashley Ellerin -- who was linked to Ashton Kutcher at the time of her death.

Michael Gargiulo, who's been in custody for several months for a different crime, was officially charged with two murders today -- one of which was Ellerin's.

Two of his attorneys, Elana Goldstein and David Murphy, tell TMZ, "Our client vehemently denies all allegations against him and any involvement in any of these murders."

Ellerin was found stabbed to death in her apartment. The night of her murder, Ashton showed up at her house to pick her up for a Grammy party, but left when she didn't answer the door.

Gloria Swings Lowe

The woman accusing Rob Lowe of all sorts of sexual misdeeds has made an unusual legal move.

We've obtained an appeal filed by Jessica Gibson's ever-shy lawyer, Gloria Allred, asking the higher court to reinstate some of the claims her client is making against Rob Lowe. It's unusual for two reasons. One -- Gloria claimed victory when the judge threw out portions of the suit and countersuit on both sides. Never heard of appealing a victory.

More significantly, by filing appeal, it freezes the ability of the parties to take depositions. Gloria basically said she was living for the moment when she could put Rob's ass under oath and take his depo. That could now be delayed for a month. It raises the Nancy Kerrigan question -- whhhhhhy?

UPDATE: Gloria just told TMZ although they can't take Rob's depo because of the appeal, "we can still obtain statements from witnesses informally." Maybe they'll try the case at Starbucks.

A wild brawl broke out at a Three 6 Mafia concert last night in West Hollywood. Body count -- two arrested and a woman wheeled out on a gurney -- and it wasn't Britney!

As we just reported, the D.A. has charged Phillips with two felonies in connection with her drug bust at LAX last week.

No surprise that her mega-lawyer, Blair Berk, now has ammo in her arsenal -- namely, that Mackenzie is taking steps to deal with her drug problem. FYI, she's been in rehab nine times before.

Mackenzie Phillips: Two Felonies at a Time

UPDATE: Phillips' lawyer, Blair Berk, just appeared in court on Mackenzie's behalf and continued the case. The judge said he expects the case will settle. Berk is famous for plea bargaining cases and saving celebrity asses.

Troubled actress Mackenzie Phillips has been charged with two felonies stemming from her arrest at LAX on August 27.

She was charged with one count of felony possession of cocaine and another for possession of heroin. The DA tacked on a misdemeanor charge of unauthorized possession of a hypodermic needle or syringe ... just for kicks.

Phillips was popped at LAX after baggies of cocaine and heroin fell out of her pants while going through airport security.

You're looking at the jewel thief with the biggest stones on the planet -- and we're not even talking about the $7 million dollars worth of rocks he stole!
Cops say this guy and three others robbed legendary, undefeated boxing champion Floyd Mayweather Jr., stealing around $7 million worth of bling from the fighter's Las Vegas mansion on August 17. As first reported by BoxingScene.com, the mystery dudes allegedly busted through Floyd's bedroom window when Mayweather was out.

Now, the Las Vegas Metro Police Dep. is looking to the public to help identify Johnny Brassballs (obviously not his real name). If you know anything, call the LVMPD at 702-828-4431 or report the crime anonymously at 702-385-5555.

Howard K: Gay, Schmay, Now You Pay

Howard K Stern says he smells the two rats who allegedly concocted lies and fed them to Rita Cosby in her tell-all book -- and the rodents are Jackie Hatten and Mark Speer, Larry Birkhead's former bodyguard.

TMZ has obtained a copy of a defamation lawsuit Stern just filed in L.A. County Superior Court. He claims Hatten -- the sister of Anna Nicole Smith's crazy ex-con ex-boyfriend Mark -- fed lies to Cosby, including the one that Stern gave lip service to Larry B ... in a Paris Hilton kind of way. Cosby's already been sued for publishing the allegation ... et tu, Jackie.

And there's more ... Stern is also suing Mark Speer, the dude Debra Opri hired to bodyguard Birkhead. Larry fired Speer, and Stern claims the scorned heavy then made up lies, which he spoon fed to Cosby. The alleged lies include claims that Stern was stealing money from Anna and striking back door deals with Birkhead over Dannielynn.

Stern is suing Hatten and Speer for unspecified damages.

BTW, Mark Hatten was busted for DUI today.

Malibu Prosecutors Hang Two

The two dudes who led the oceanfront smackdown on a pack of pappers have been charged with criminal brutality.

As Matt McConaughey surfed carelessly in Malibu, Skylar Martin Peak and Philip John Hildebrand -- two locals -- took it upon themselves to protect their turf. Prosecutors claims they went too far, and charged both hooligans with misdemeanor battery.

Surfs up, and so's your bail.

Fred Taylor -- Jacksonville Jackass

We've just gotten the Jacksonville Jaguar Fred Taylor arrest report early Saturday morning, and it's like a clinic on how NOT to deal with the popo.

First, says the arresting officer, Taylor got "vocal" and began to "argue" with cops and "attempted to insite [sic] the crowd of bystanders" when they wanted to search his Benz for guns. Then, when they sent a sniffer pooch to look for drugs, Fred really got testy, yelling, "Get that f***ing dog out of the car."

It got so bad, the cops gave up and just booked his ass for disorderly conduct. Taylor apologized to fans and the owner of the Jags for the incident.
